Arizona Ignition Interlock Program: Your Simple Guide to DUI Compliance
Getting a DUI is stressful. Now that the court has ordered you to use an ignition interlock device (IID), you are focused on following the rules and getting your license back. It is important to get this right so you do not have to keep the device longer than needed.
Here is a simple breakdown of what you need to do to comply with the Arizona Motor Vehicle Division (MVD) ignition interlock program.
Phase 1: Installation and Your New License
The first steps are the most critical to starting your required time correctly.
- Install the Device on Every Car You Drive
You must install a Certified Ignition Interlock Device (CIID) on every single vehicle you operate, including any cars you drive for work. Arizona law requires the device to be equipped with a camera, GPS, and real-time reporting.
- Meet the 30-Day Deadline
If you have received an order to install an interlock device, you must have it installed and provide verification to the MVD within 30 days of your conviction. If you miss this deadline, your driving privilege will be immediately suspended, and your interlock requirement may be extended.
- Sequence Matters: Install First, Then Reinstate
- First: Have the interlock device installed by an approved provider. Your provider will send electronic confirmation to the MVD.
- Second: Log in to your AZ MVD Now account to pay your reinstatement fee and apply for your new Special Ignition Interlock Restricted Driver License (SIIRDL). You cannot legally drive until you have done this.
- Know Your Timeframe
The average requirement is 12 months, but this can vary based on your conviction. Your required time starts on the later of two dates: the date your driving privilege is eligible to reinstate, or the date the MVD receives the report of your conviction.
Phase 2: Staying Compliant (The Daily Rules)
Once installed, you must follow these rules without fail.
- Calibration Appointments Are Mandatory
Your provider must check and calibrate your device at least once every 90 days. Missing a scheduled 90-day appointment is a major violation that will cause your driver’s license to be suspended and your original interlock time to start over from the beginning.
- Pass the Tests
- Starting the Car: You must blow into the device and register a breath alcohol content (BAC) of under 0.020 to start your vehicle.
- Rolling Retests: The device will require random breath samples while you are driving. You must provide the sample when prompted. Missing three consecutive rolling retests during one drive is a violation.
- Be Careful of False Positives
Many common household items contain alcohol that can trigger a failed test. Avoid using things like mouthwash, hand sanitizer, cologne, or certain medications right before or while driving. Wait 10 to 15 minutes after using any of these products before providing a sample.
- You Are Responsible for All Drivers
Someone else can drive your car, but they must blow into the device and follow all the rules. If they cause a violation, you are the one who will face the consequences, including an extension of your requirement.
Phase 3: Violations and Removal
You must avoid violations to ensure you complete the program on time.
What Causes an Extension or Suspension:
- Failed Breath Tests: Registering two failed breath samples over the legal limit (if you are over 21) will be reported as a violation and may extend your interlock time by 6 months.
- Tampering/Circumvention: Do not try to disconnect, disable, block the camera, or ask another person to blow into the device for you. This is a serious violation and can extend your requirement by 6 to 12 months.
- Driving a Car Without the IID: If you are caught driving any vehicle without the required interlock, your requirement will be extended for one additional year after your original time was set to end.
Getting the Device Removed
When you think your time is up:
- Do not remove the device early. This will cause a license suspension and force you to start your original interlock time over.
- Verify Eligibility First. Log into your AZ MVD NOW account or contact the MVD to confirm you are eligible for removal.
- Once MVD confirms your eligibility, you can schedule your removal with your interlock provider.
